Canadian Anti-Spam Legislation (CASL) came into effect July 1, 2014 impacting how businesses can communicate electronically. While the requirements are relatively simple in macro terms, in actual application, CASL is not easy to comply with and is filled with nuances and subtle complexities that challenge all businesses. Although senior management looks at IT, the reality is that CASL affects many departments including, not limited to: IT, Legal, Risk, Marketing, Compliance and HR. Departments and/or individuals require solution dealing with distributed geographic locations and different divisions throughout Canada, with hundreds or even thousands of users; vast numbers of source databases for e-mail addresses; wide and varied uses of e-mail addresses; numerous systems/platforms, many of which are not integrated in any way; and various devices used to send e-mails all combine to make compliance complex and challenging.

CASL is evolving to not only become a regulatory requirement, but potentially costly legal risk if not addressed properly. On July 1, 2017, the law will allow private right of action by individuals who can sue individuals and their companies on an e-mail by e-mail basis – at $200 per e-mail recipient, supported by class action litigation. These suits can result in decisions of up to $1 million per day based on failure to comply.

Neil Beaton, V.P. of Corporate Development for both The OTC Group and CASL Cure, will share a detailed review of the complexities and a challenge created by this law in its current form and as it evolves in 2017. He will review some cases studies of companies fined by the CRTC. He will also provide an overview and demo of how these challenges can be dealt with in an integrated and automated manner to help you prepare for 2017.

Shawn Slack is the Director of Information Technology and Chief Information Officer for the City of Mississauga.
Early in his career with the City of Mississauga, he led the vision and plan to provide all City services online. He also oversaw the implementation of the City’s first Customer Service Strategy which transformed customer service across all channels including internet, phone and counters as well as the implementation of 311. 

Currently, Shawn is engaged in many great initiatives and projects guided by a new IT Master Plan endorsed by Council in 2015 which focuses on Fostering Open and Accessible Government, Enabling Decisions through Research & Analytics, Creating a Connected & Engaged Workplace and Improving Services through Innovation & Partnerships.
